If this creates too much of a focal point consider painting the brick several shades darker while using only the mantel to match the trim. Brick takes a particular method and types of paint to make sure that the paint is handled correctly by the brick and comes out looking the right way in regards to shape and texture.

i think reporting him to the insurance company would get you farther than trying to sue him. depending on the size of the place you went to they may have some bigtime scumbag lawyer that they pay yearly that will fight against you.
